Terms & Conditions

By adding Rent & Legal Protection to this tenancy you agree that this protection will be added to your policy on the basis that:

  • this protection is issued to the letting agent and not the landlord. The landlord acquires no rights and cannot make a claim. The letting agent agrees to pay the benefit of any successful claim to the landlord, less any agreed management fees (if applicable).
  • the insured properties are let, or to be let under:
    • an Assured Shorthold Tenancy Agreement as defined within the Housing Act 1988 (as updated and amended by the Housing Act 1996) within the Territorial Limits, or
    • a Private Residential Tenancy as defined within the Private Housing (Tenancies) (Scotland) Act 2016 (as amended); or
    • the Private Tenancies (Northern Ireland) Order 2006; or
    • a standard occupation contract under the Renting Homes (Wales) Act 2016; or
    • a Company Residential Tenancy (Company Let) created after 28th February 1997 where the Tenant is a public limited company (plc) or limited company (Ltd) or its equivalent outside of England and Wales but within the Territorial Limits and the Property is let purely for residential purposes of the Tenant’s employees and their family.
  • you are not aware of any circumstances or instances which may give rise to a claim, have been refused insurance or have had any special terms applied.
  • the insured properties are in a good state of repair and will be regularly maintained.
  • the insured properties are situated in the United Kingdom.
  • the tenant(s) have received an Elite or Essential++ reference from The Lettings Hub showing an ‘Accept’ decision or, a certified or uncertified++ Property PassportTM with a Tenancy Score of 40 or more. Where the Elite/Essential++ reference or Property PassportTM state tenant(s) require a suitable guarantor, a guarantor must also be named in the tenancy agreement and have received an ‘Accept’ recommendation on an Elite or Essential++ reference or a Tenancy Score of 40 or more on a certified or uncertified++ Property PassportTM. All conditions noted in the reference must be met for both tenants and guarantors. A satisfactory reference from an alternative licenced tenant reference agency is acceptable if it meets the Comprehensive Reference criteria detailed in the Policy Booklet.
  • a new Comprehensive Reference will be obtained where the tenancy rent has increased by more than 10% in the past 12 months and the new rent exceeds the tenant’s affordability limit confirmed in the last Comprehensive Reference.
  • a full and detailed inventory of contents and condition of the property has been carried out and agreed (and signed if applicable) by the tenant.
  • you will not allow any tenant into the property until the first month’s rent and either:
    • a minimum amount equal to four weeks’ rent (if rent is paid weekly) or one month’s rent (if rent is paid monthly) has been taken as the tenant’s deposit and registered with a tenancy deposit scheme in accordance with current legislation; or
    • deposit replacement insurance has been purchased in lieu of a deposit with a sum insured equal to or exceeding four weeks’ rent (if rent is paid weekly) or one month’s rent (if rent is paid monthly).
  • any claim will be reported to The Lettings Hub no later than 45 days after the date you should have known about the insured incident.
  • you will not enter into a tenancy where a person has been requested to act as a guarantor for the tenant unless that person has been satisfactorily referenced and that person has entered into a legally enforceable written contractual guarantor agreement in respect of the tenancy wherein the guarantor will guarantee the performance of the tenant’s obligations within the tenancy for as long as the tenant remains in the property.
  • where the tenancy started before the protection commenced, cover can only be offered where there has been continuous rent protection and legal expenses cover in place since the start of the tenancy. However, where the tenant(s) have previously paid in advance but now wish to pay the next tenancy term monthly or weekly, you will obtain a comprehensive reference.
  • any mortgage conditions of the tenancy will be complied with.
  • you will ensure a clear record of all rent due and payments received, including the date of any payment received, is kept and submitted to us at point of claim.
  • upon vacant possession being obtained, a detailed inventory of the contents and condition of the property together with, if applicable, a schedule of dilapidations will be prepared.
