This facility is designed as a guide only to help you complete right to rent checks in line with the latest legislation. However please remember that it remains the legal responsibility of the landlord and their letting agent to ensure the requirements of the Immigration Act 2016 have been met. We recommend you familiarise yourself with the government guidance and landlords’ code of practice to ensure you understand and remain compliant with your legal responsibilities.

You must conduct a right to rent check before you rent to a prospective tenant for all applicants over the age of 18, even if they are not named on the tenancy agreement. It is a criminal offence in England to rent to someone who you knew or had ‘reasonable cause to believe’ did not have the right to rent in the UK, punishable by up to five years in prison or an unlimited fine.

Please remember that right to rent checks do not form a part of the referencing process; a right to rent check does not mean your applicant is suitable for the tenancy.

The temporary adjustments to right to rent checks due to the pandemic can no longer be used with effect from 1st October 2022.
