
Material Information Guidance: What Letting Agents Need To Know

National Trading Standards has withdrawn the Material Information guidance, but the legal obligations for letting agents remain unchanged. Letting agents are still required to disclose all material information that could influence a tenant’s decision to rent. This responsibility is now governed by the Digital Markets, Competition and Consumers Act 2024 (DMCC Act), which is enforced by the Competition and Markets Authority (CMA), with the authority to impose penalties directly.
While there is no longer a checklist or template, the expectation for full transparency remains the standard. The updated legal landscape under the DMCC Act introduces new responsibilities, and non-compliance carries risks.
